Counting Sheep Giveaway Rules & Privacy

1. IDENTIFICATION

This Contest is offered to you, under the conditions outlined below, by Smart NV, with registered office at Neerveld 14, 2550 Kontich, Belgium, with company number BE 0448.827.611, producer and seller of, among other things, SmartGames.

2. DEFINITIONS

2.1 For the purposes of this Contest Rules document, the following terms, indicated with a capital letter, shall mean:

  • "Contest Rules" means this regulation containing the conditions concerning the Contest.
  • "Organiser" means Smart NV, with registered office at Neerveld 14, 2550 Kontich, Belgium, company number BE 0448.827.611.
  • "Packages" means:
    • Package 1: 1 SmartGames – Counting Sheep value of 17.99€.
    • Package 2: 1 SmartGames – Counting Sheep value of 17.99€.
    • Package 3: 1 SmartGames – Counting Sheep value of 17.99€.
    • Package 4: 1 SmartGames – Counting Sheep value of 17.99€.
    • Package 5: 1 SmartGames – Counting Sheep value of 17.99€.
  • "Participant" means any natural person, at least 18 years old, residing in Belgium, the Netherlands, Luxembourg, France, the United Kingdom, Germany, or Austria, participating in the Contest for non-professional purposes and exclusively for themselves, excluding:
    • 1. Persons who sit on the board of directors of the Organiser;
    • 2. Persons employed by the Organiser;
    • 3. Persons employed by or appointed by companies responsible for the development, implementation, or management of the Contest (directly or indirectly), including subcontractors;
    • 4. Persons living at the same legal residence or who are first- or second-degree relatives of any of the above-mentioned individuals.

3. OBJECT OF THE CONTEST

3.1 The Contest offers the chance to win one of 5 games.

3.2 No purchase is required. Go to www.smartgames.eu, play the digital game, answer the contest question, enter your details, and submit your entry.

4. PRIZES, WINNER SELECTION, PRIZE COLLECTION

4.1 Prizes: 5 games as outlined above.

4.2 The prizes are strictly personal, non-transferable, and cannot be exchanged for cash.

4.3 The 5 winners will be the Participants who:

  • Answer the question and enter their details
  • The winners will be chosen by random in a lucky draw

4.4 Winners will be notified by email on the 26th of June 2025. They will be asked for their address, and the prize will be sent by post at the Organiser’s expense.

4.5 The winner must inform the Organiser of their address via email.

4.6 If a winner provides incorrect information, they will be disqualified, and the prize will be awarded to the next in line.

5. SPECIAL CONDITIONS

5.1 To participate in the Contest:

  • Play the digital game - Counting Sheep on www.smartgames.eu,
  • Answer the 1 question: How many people do you think would have participated in this contest between 15th - 26th of June 2025.
  • Fill in your personal details (name, surname, and email address),
  • Agree to the contest rules, privacy and cookie policy, and submit your entry online.

5.2 The Contest cannot be combined with any other contest, promotion, discount, bonus, or offer from the Organiser.

5.3 Participation is only valid through the form on www.smartgames.eu.

5.4 Participation is limited to one entry per valid email address. Any disqualification results in the forfeiture of future participation.

5.5 A person can only win once, even if multiple email addresses are used. Winning a Package is non-cumulative.

6. DURATION OF THE CONTEST

6.1 The Contest runs from 15/06/2025 00:00 to 26/06/2025 23:59.

7. ACCEPTANCE

7.1 By participating, the Participant declares to have read and accepted the Contest Rules without reservation. If applicable, the Participant also agrees to any rules imposed by social media platforms used by the Organiser.

7.2 By participating, the Participant acknowledges that the Organiser cannot be held liable in connection with the Contest, except in cases of fraud or intentional error. The Organiser is not responsible for any direct or indirect damage resulting from participation.

8. PERSONAL DATA PROCESSING

8.1 Personal data is collected and processed in accordance with the Smart Group’s Privacy Policy, published at www.smartgames.eu.

8.2 The Organiser will process the Participant’s personal data as provided in the form or collected via first- or third-party cookies. These will be used to facilitate participation, identify winners, contact them via email or phone, and publish the names on Facebook and Instagram. With consent, the data may also be used to send newsletters.

8.3 The Organiser will retain personal data only as long as necessary to fulfil the Contest or other processing purposes accepted by the Participant, unless required otherwise by law.

8.4 The Participant has the right to:

  • Access their data, its purpose, and the categories of data recipients;
  • Receive a copy of the data in an understandable format;
  • Understand the logic behind any automated decisions (only if applicable);
  • Request correction of incorrect data;
  • Object to processing on compelling grounds;
  • Request deletion or blocking of irrelevant or unlawfully processed data.

8.5 The Participant has the right to object free of charge and without justification to the processing of their data for direct marketing purposes.

8.6 If a Participant who previously agreed to receive emails unsubscribes, their data will be removed from the mailing list. Unsubscribing is possible via the unsubscribe link in emails or by simple request to privacy@smart.be.

9. MISCELLANEOUS

9.1 The Organiser reserves the right to exclude any Participant from the Contest or reclaim prizes in case of rule violations, fraud, or dishonest behaviour. These decisions are final and not subject to appeal.

9.2 The Organiser reserves the right to amend the Contest Rules.

9.3 If any part of the Contest Rules is found invalid or unenforceable, the Organiser will replace it with a valid provision that closely reflects the intent. This is at the Organiser’s sole discretion and cannot be contested.

9.4 Belgian law applies. Any disputes will be handled by the courts with jurisdiction over the Organiser’s registered office.
